Jodi Colton is a graduate of Harvard Law School and a Partner at the law firm of Brinkley Morgan.

Ms. Colton’s legal career began in the New York City office of Latham & Watkins and she also practiced at large firms in Philadelphia and Minneapolis where she worked on a broad range of litigation matters in federal and state courts. Ms. Colton draws upon her background in commercial litigation to assist her clients in sophisticated family law matters. She routinely represents high net worth and high-profile clients in cases involving valuation and equitable distribution of financial and business assets, including closely held corporations, professional practices, real estate, deferred compensation plans, and stock plans, as well as timesharing and parental responsibility/custody issues.
Ms. Colton is AV Preeminent Rated by Martindale-Hubbell. An active member of the community, she currently serves as Chair of the 15th Judicial Circuit Local Professionalism Panel and is involved in various local and statewide organizations.

The length of a divorce varies substantially depending on lots of factors. A traditional litigated divorce can go on for years. Even a relatively amicable traditional divorce can take about a year. Some of the factors are how quickly both parties gather the necessary financial information, whether depositions or hearings are needed along the way, how complex the assets are, and whether there are disagreements relating to the children. If you use the Collaborative Process, your divorce you have much more control over the length of the process. A Collaborative divorce is usually much faster than a traditional litigated divorce. In some instances the parties may which to move more slowly to manage other family needs, such as waiting until a child finishes the school year or waiting for a house be sold before finalizing the divorce. The Collaborative Process allows the parties to control the timing to suit their family’s needs.
Collaborative law is an option for couples that wish to keep their divorce private. Each party engages a Collaborative attorney, then works with a team of experts to reach a sensible resolution. The Collaborative Team, including the parties, meets together to negotiate a settlement that focusses on each party’s interest and how to achieve a resolution that meets each party’s needs while maximizing the benefits to both parties.
The Collaborative Process is often an excellent option to help families restructure in a way that preserves the relationships and achieves the best possible result for the parties and their children. Collaborative Divorce is often more economical than a traditional court-based divorce. It also provides a privacy and confidentiality. At the conclusion of a collaborative divorce, the Court will enter a Final Judgment of Dissolution of Marriage, which is the legal divorce decree, and will incorporate the parties’ settlement agreement. In most cases, the Parties are not required to file their Financial Affidavits or financial disclosure with the Court, keeping their financial circumstances out of the public view. In many instances the Collaborative Marital Settlement Agreement can also be kept confidential and out of the public Court file.

Florida law applies to all divorces in Florida and negotiations in a Collaborative divorce take into consideration Florida statutes and case law that would apply in any traditional divorce. However, parties have the ability to deviate from the law if they both agree, or to come up with more creative ways of resolving their situation that may or may not be the same thing a Judge likely would or could do. Family law has many gray areas and there is often a range of possible outcomes and ways to accomplish the division of assets, or how support will be provided by one spouse to another.
No one can predict what a judge will do, but when the court resolves a divorce, one party wins and the other loses. A judge has many fewer options for how to resolve your case. Settlement agreements reached in the Collaborative Process allow us to be creative in coming up with solutions tailored to the specific goals and concerns of each individual family.
